Terms of Use
Article 1 (Purpose)
These Terms of Use are intended to set out the conditions of use of the services of "DOB LOGIS" (hereinafter the "Site") and all matters relating to their operation.
Article 2 (Definitions)
The main terms used in these Terms are defined as follows:
(1) Member: a person who has agreed to the Site's terms, provided personal information, and completed membership registration, thereby entering into a use agreement with the Site and using the Site.
(2) Use Agreement: the agreement entered into between the Site and a Member in connection with use of the Site.
(3) Member ID ("ID"): a unique combination of letters and numbers assigned to each Member to identify the Member and enable the Member's use of the service.
(4) Password: a combination of letters and numbers chosen by the Member to confirm that the Member matches the assigned ID and to protect the Member's interests.
(5) Operator: the operator who has opened and operates a website on the service.
(6) Termination: a Member's cancellation of the Use Agreement.
Article 3 (Rules Outside These Terms)
The Operator may separately announce operating policies where necessary. Where these Terms and an operating policy overlap, the operating policy shall prevail.
Article 4 (Formation of the Use Agreement)
(1) The Use Agreement is formed by the consent of a person who wishes to register as a Member and use the Site to the content of these Terms, together with the Operator's acceptance of the application for membership.
(2) A person who wishes to register as a Member and use the service expresses consent to these Terms by reading these Terms at the time of applying for membership and selecting "I agree" below.
Article 5 (Application for Use of the Service)
(1) A user who wishes to register as a Member and use the Site must provide the information requested by the Site (user ID, password, nickname, etc.).
(2) A Member who has not registered his or her own true information, such as by stealing another person's information or registering false information, may not assert any rights in connection with use of the Site and may be punished under applicable law.
Article 6 (Privacy Policy)
The Site and the Operator do not hold the password among the personal information provided at the time of membership registration, and matters related thereto are governed by the Site's Privacy Policy.
The Operator endeavors to protect Members' personal information, including membership registration information, in accordance with applicable law.
Protection of Members' personal information is governed by applicable law and the Privacy Policy established by the Site.
However, the Operator bears no responsibility whatsoever for information exposed due to reasons attributable to the Member.
Where a Member registers or distributes unlawful postings, such as postings that undermine public morals or violate national security, the Operator may, upon request of the relevant authorities, review the Member's data and submit such data to those authorities.
Article 7 (Obligations of the Operator)
(1) Where the Operator acknowledges that an opinion or complaint raised by a Member is justified, it shall handle it as promptly as possible. However, where prompt handling is difficult due to personal circumstances, the Operator shall do its best, such as by giving notice afterward or sending the Member a message or email.
(2) For continuous and stable provision of the Site, the Operator may require the Site to repair or restore any equipment failure or loss without delay. However, in the case of a natural disaster or an unavoidable reason on the part of the Site or the Operator, operation of the Site may be temporarily suspended.
Article 8 (Obligations of the Member)
(1) The Member shall comply with the matters set out in these Terms, the various rules, notices, and operating policies established by the Operator, other matters announced by the Site, and applicable law, and shall not engage in acts that interfere with the Site's operations or that damage the Site's reputation.
(2) Without the express consent of the Site, the Member may not transfer or give to another person the right to use the service or any other status under the Use Agreement, nor provide it as security.
(3) The user shall exercise considerable care in managing the ID and password, and may not allow a third party to use the ID without the consent of the Operator or the Site.
(4) The Member shall not infringe the intellectual property rights of the Operator, the Site, or any third party.
Article 9 (Service Hours)
(1) In principle, service is available 24 hours a day, year-round, unless there is a special operational or technical impediment. However, the Site may temporarily suspend the service on dates or times set by the Site for regular system maintenance, expansion, or replacement, and service suspensions due to scheduled work will be announced in advance on the Site's website, so please check from time to time.
(2) However, the Site may suspend the service temporarily or permanently without prior notice in the following cases:
- Urgent system inspection, expansion, replacement, or in the event of a breakdown or malfunction
- Force majeure such as a national emergency, power outage, or natural disaster
- When a key telecommunications provider under the Telecommunications Business Act has suspended telecommunications service
- When normal use of the service is impaired due to a surge in service usage or similar
(3) In the case of a service suspension under the preceding paragraph, the Site shall notify Members in advance through notices or similar. However, where prior notice is impossible due to reasons beyond the Site's control, notice afterward shall substitute for it.
Article 10 (Termination of Service Use)
(1) A Member who wishes to terminate the Use Agreement with the Site must apply for cancellation of registration online in person. Separately from termination of Site use, termination of the use agreement for the Site must be done separately.
(2) Upon the termination request, the Site-related programs provided by the Site are automatically deleted from the member management screen, so the Operator can no longer view the information of the person who requested termination.
Article 11 (Restrictions on Service Use)
The Member shall not engage in any of the following acts. If the Member does so, the Site may restrict the Member's use of the service and take lawful measures, and may terminate the Use Agreement or suspend the service for a set period:
(1) Registering false information at the time of membership registration or when changing information afterward
(2) Interfering with another person's use of the Site or stealing information
(3) Impersonating the Site's operators, employees, or affiliates
(4) Infringing the personal rights or intellectual property rights of the Site or any third party, or interfering with their business
(5) Improperly using another Member's ID
(6) Collecting, storing, or disclosing another Member's personal information without consent
(7) Acts objectively judged to be connected with a crime
(8) Other acts that violate applicable law
Article 12 (Management of Postings)
(1) Responsibility for the management and operation of the Site's postings and data lies with the Operator. The Operator shall constantly monitor for harmful postings and data, and upon discovering or receiving a report of harmful postings or data, shall delete such postings or data and warn the Member who registered them. Responsibility for a posting uploaded by a Member lies with the poster, so Members themselves must not post content that violates these Terms.
(2) Where there is a corrective request from a public agency such as the Information and Communications Ethics Committee, the Operator may delete or move the posting without the Member's prior consent.
(3) The criteria for judging a harmful posting are as follows:
- Content that severely insults or damages the reputation of another Member or a third party
- Content that spreads or links to material that violates public order and public morals
- Content that promotes illegal copying or hacking
- Advertising for commercial purposes
- Content objectively recognized as connected with a crime
- Content that infringes copyright or other rights of another user or a third party
- Other content judged to violate applicable law
(4) Where the Site or the Operator receives a request from a third party to suspend a posting on the grounds of defamation, infringement of intellectual property rights, or similar, it may temporarily suspend the posting (suspend transmission), and shall comply where litigation, settlement, or an equivalent decision by a relevant authority between the requester and the poster is reached and submitted to the Site.
Article 13 (Retention of Postings)
Where the Site operator must discontinue the Site due to unavoidable circumstances, it shall give prior notice to Members and endeavor to take all measures to facilitate the migration of postings.
Article 14 (Copyright of Postings)
(1) The copyright of a posting placed by a Member on the Site belongs to the Member who posted it. The Site may not use the posting commercially without the poster's consent. However, this does not apply for non-commercial purposes, and the Site also holds the right to publish it within the service.
(2) The Member may not use materials published in the service commercially, such as by arbitrarily processing or selling information obtained by using the service.
(3) Where the Operator judges that content or postings placed or registered by a Member on the Site fall under any item of Article 12, it may delete, move, or refuse registration without prior notice.
Article 15 (Damages)
(1) All civil and criminal liability arising on this Site lies primarily with the Member.
(2) Where damage suffered by a Member from this Site is due to force majeure such as a natural disaster, or arises from the Member's intent or negligence, no damages shall be paid.
Article 16 (Disclaimer)
(1) The Operator is exempt from liability for a Member's failure to obtain expected benefits from the service, or for damage arising from the Member's selection or use of service materials.
(2) The Operator is exempt from liability in the case of a failure of the service infrastructure of this Site or of telecommunications services provided by other carriers, and damage related to the service infrastructure of this Site is governed by the Site's Terms of Use.
(3) The Operator bears no liability whatsoever in connection with materials stored, posted, or transmitted by a Member.
(4) The Operator bears no liability where an impediment to service use arises due to reasons attributable to the Member.
(5) The Operator bears no liability for any activity between Members, or between a Member and a third party, whether inside or outside this service (including data transmission and other community activities).
(6) The Operator bears no liability for the authenticity, reliability, accuracy, or other content of materials posted or transmitted by a Member and all materials a Member may receive through this Site.
(7) The Operator bears no liability for any damage arising where Members, or a Member and a third party, trade goods or similar through the service.
(8) The Operator bears no liability for any dispute arising between Members, or between a Member and a third party, without fault on the part of the Operator.
(9) The Operator bears no liability for a Member's damage arising, without intent or gross negligence equivalent to intent, in the course of managing, inspecting, repairing, or replacing equipment such as servers or operating software; system failures caused by a third party's attack; the spread of computer viruses for which countermeasures have not been developed by renowned domestic or foreign research institutions or security companies; or other force majeure beyond the Operator's control.
Addendum
These Terms take effect from <the date the Site is opened>.
